This Privacy Policy establishes the terms and conditions under which EXXENTRIC AB (hereinafter “Exxentric”) processes the personal data that you provide Exxentric with when using the website www.exxentric.com (hereinafter “the Exxentric website” or “the website”), the mobile application or app, understood as the software application designed to be used on smartphones, tablets or other mobile devices (hereinafter “the App”) or other applications, software, digital media, storage medium, or functionalities related to the commercial brand Exxentric (jointly, “the Platform”).

When using the Platform, each time you provide Exxentric with or it is necessary for Exxentric to access any kind of information which, due to their characteristics, allow Exxentric to identify you, such as your name, surname, email address, billing or shipping address, telephone number, credit or debit card number, etc. (hereinafter, “Personal Data”), whether for purposes of browsing, purchasing our products, communicating with Us or using our services or functionalities, you will be subject to this Privacy Policy which are applicable at all times and should be reviewed to ensure you agree with them.

This means Exxentric is responsible for defining the purposes for processing your personal data and for compliance with the data protection legislation. Exxentric keeps your personal data for no longer than is necessary for the purposes for which the personal data are processed. Personal data may be stored for more extended periods insofar as other legislation demands it.

Most data collected by Exxentric is stored digitally by a third party such as Google. Exxentric complies with the security of collected data and guarantees only employees of Exxentric have access to this information.

Your personal data will only be shared with third parties if permitted by law, including to process contracts or settlements, for promotional purposes or if you have previously given your consent. For example, in the context of order processing, service providers (such as shipping and logistics companies) may require the information required for order and order handling. Like many other websites, the Exxentric website automatically collects information of your behaviour through cookies. It does not contain any personal data although our tools extract demographic information from your IP address, including for example geographic location. Exxentric analyzes your cookie data by using the tool Google Analytics. The configuration of these cookies is predetermined by the service offered by Google (the “processor”) and the information generated by the cookie about the use of the website will be transmitted and stored by Google, Inc. We collect, store and process your personal data for the complete processing of the purchase process, including any subsequent warranty cases for our customer services, technical administration, marketing and to prevent criminal acts and fraud. When finalizing your purchase on our website you will be requested to provide your credit card details. This information is processed by a secure third-party payment processor. Exxentric does not collect or process this data.

When you place a new order or otherwise seek support from us, we will process the above-mentioned personal information we have collected from you.

Health Data and Fitness Data

The Exxentric App includes fitness and training-related features and may process health and fitness data when you choose to use those features.

What data we process

Depending on the features you use and the permissions you grant, we may process:

• workout and training data created through your use of the App, such as training sessions, exercise data, performance metrics, power, force, and related workout information;
• basic fitness/activity data that you choose to sync with Apple Health or Android Health Connect, such as active minutes;
• live heart rate data from a connected compatible heart rate monitor, such as a Polar heart rate monitor.

How we use this data

We use health and fitness data to provide the App’s training and fitness functionality, including to:

• display workout and performance information in the App;
• display live heart rate information during training when you connect a compatible heart rate monitor;
• save and maintain your training history and related training metrics in the App;
• sync selected fitness data with Apple Health or Health Connect when you choose to enable those integrations;
• provide support, troubleshoot issues, and improve the App’s functionality.

Heart rate data

At present, heart rate data from a connected heart rate monitor is displayed in the App during use of supported features. It is currently not stored as part of your saved session data unless and until this functionality is introduced in a future update.

Apple Health and Health Connect

Apple Health and Health Connect integrations are optional. They are not enabled by default. Data is only synced if you choose to connect and authorize these integrations. You can also remove or disconnect these integrations at any time through the App and/or your device settings.

Sharing

We do not sell health or fitness data.

We may share health and fitness data only:

• with service providers acting on our behalf where necessary to operate the App and related services;
• with Apple Health or Health Connect when you choose to enable those integrations and authorize syncing;
• where required by law or necessary to establish, exercise, or defend legal claims.

Retention

We retain health and fitness data only for as long as necessary to provide the App’s features, maintain your account and training history, comply with legal obligations, resolve disputes, and enforce agreements.

Your choices

You control whether to connect health platforms and compatible heart rate devices. If you do not grant the relevant permissions or do not connect these services/devices, the related features will not be available.

Exxentric strives to provide the best customer support possible. For us to be able to help you as our customer, we will process your personal data to identify you and help you as best we can. On our website or social media accounts, you may be able to start a live chat or submit a questionnaire form. You may also contact us by phone, email or regular mail. When you communicate with us via any of these means, we will help you with inquiries, questions or feedback concerning our products or services depending on your inquiry, question or feedback; you may be asked to provide additional personal data, such as your credit card number or your bank details.

After you have contacted Customer Support, we will examine the content of our communication with you and if necessary due to the characteristics of the data erase parts of it.

In addition to collecting your data for purchase processing at Exxentric, we also use your data for purposes: to permanently enhance your shopping experience and make it even more customer-friendly and individual; to communicate with you about your orders, as well as about specific products or marketing campaigns; and to recommend products or services that may interest you. For this purpose, we use existing information, such as delivery and read receipt of e-mail, date and time of the visit of the website or products that you have looked at as well as information we received from you (including automatically transmitted or generated information). In addition, we also use your order history.

You may object to the use of your personal data for advertising purposes at any time. This applies to all advertising purposes and individual actions.

The Exxentric Platform is not targeted to children. Individuals between the ages of 13 to 16 will require consent given or authorisation by the holder of parental responsibility.  Exxentric rejects persons under the age of 13 to submit personal data to Exxentric. If it comes to our knowledge that we despite our best intentions collected personal data about a child under the age of 13 or an individual between the ages of 13 and 16 without parental approvement, we take all necessary steps to remove the information as soon as possible.

If you are a resident of the European Union you have the right to, in consonance with the EU General Data Protection Regulation, request the following by Exxentric; access to, and correction or deletion of your personal data, data portability, limitation of processing of your personal data, the right to object to the processing of your personal data and the right to file a complaint with a regulatory authority. If you reside outside the European Union, you may have similar rights under local laws.
